2. About Curemploy

Curemploy is a healthcare and pharmacy recruitment platform that facilitates connections between Job Seekers and Employers. Employers onboard their establishment, purchase a Plan where applicable, and publish Listings. Job Seekers create a profile, browse Listings and apply or connect with Employers.

Curemploy acts only as an intermediary platform within the meaning of Section 2(1)(w) of the Information Technology Act, 2000. Curemploy:

  • is not the employer of any Job Seeker
  • is not a recruitment agent, placement agency or manpower supplier for any Employer
  • is not a party to any employment relationship, contract, offer or negotiation formed through the Platform
  • does not participate in salary negotiation, interviewing, selection or hiring decisions

Any employment relationship is formed directly and exclusively between the Job Seeker and the Employer. Curemploy's role ends at facilitating the connection.

3. Eligibility and User Accounts

3.1 Eligibility

  • You must be at least 18 years of age and legally competent to contract under the Indian Contract Act, 1872.
  • You must be legally permitted to work in India (Job Seekers) or to hire in India (Employers), as applicable.
  • If you register on behalf of a business, you confirm you are duly authorised to bind that business to these Terms.
  • We may refuse, suspend or terminate registration at our discretion where eligibility cannot be established.

3.2 Account obligations

  • Provide accurate, current and complete information during registration, and keep it updated.
  • Keep your login credentials and OTPs secure. Do not share them with any other person.
  • You are responsible for all activity conducted through your account.
  • Notify us immediately at Curemploy@gmail.com if you suspect unauthorised access.
  • One person or business should maintain only one active account of each type, unless we agree otherwise in writing.

3.3 Account verification

We may verify your mobile number by OTP, and may request licence, registration or identity documents from Employers as part of establishment verification. A "verified" badge, where displayed, indicates that we have carried out the checks described at the time of verification. It is not a guarantee of the Employer's conduct, solvency or the accuracy of any Listing.

4. Obligations of Job Seekers

Job Seekers are responsible for:

  • Providing accurate profile information
  • Uploading truthful resumes and documents
  • Providing accurate qualifications, pharmacy registration details and work experience
  • Applying only for positions they are eligible and qualified for
  • Keeping profile information updated
  • Dealing directly and in good faith with Employers they connect with
  • Carrying out their own due diligence on any Employer before sharing original documents, attending an interview or accepting an offer

Job Seekers must never pay money to any Employer or to any person claiming to represent Curemploy in order to secure a job. Curemploy is free for Job Seekers. Report any demand for payment to Curemploy@gmail.com immediately.

Submitting false qualifications, experience, licences or documents may result in restriction, suspension or removal of the account, and may have consequences under applicable law, including the Pharmacy Act, 1948, where registration details are misrepresented.

5. Obligations of Employers

Employers must:

  • Provide accurate business and establishment information, including any licence or registration details requested for verification
  • Post only genuine job opportunities for roles that actually exist and are currently open
  • Provide accurate salary, location, shift, working hours and job requirements in every Listing
  • Comply with all applicable labour, employment, shops-and-establishment and pharmacy regulations, including any qualification or registration requirement for the role advertised
  • Not discriminate unlawfully in Listings or in the hiring process
  • Not charge candidates any fee, deposit, security amount or payment of any kind at any stage of recruitment
  • Use candidate information solely for recruitment for the role advertised
  • Not sell, publish, transfer, share outside their organisation, or otherwise misuse candidate information
  • Not post fraudulent, misleading, duplicate or spam Listings
  • Not use the Platform to recruit for roles that require a registered pharmacist where no registered pharmacist will supervise, contrary to law

Employers act as independent data controllers in respect of candidate information they receive, and are responsible for handling it in compliance with the Digital Personal Data Protection Act, 2023.

6. Job Listings and Moderation

Curemploy may review, edit, restrict, unpublish or remove any Listing that violates these Terms, applicable law or platform policies, with or without prior notice.

Removal of a Listing for a violation does not entitle the Employer to a refund of any amount paid.

Listings may also expire automatically at the end of the period applicable to the Plan under which they were published. Where a Listing is unpublished on expiry, the Listing content and applications already received are retained and become accessible again on renewal.

We are not obliged to pre-screen Listings, and our right to moderate does not create a duty to do so.

7. Subscriptions, Plans and Paid Services

  • Certain features, including publishing Listings beyond any free allowance, require an active Plan.
  • The features, limits, duration and price of each Plan are displayed at the point of purchase and form part of these Terms.
  • Prices are inclusive or exclusive of applicable taxes as stated at the point of purchase. Goods and Services Tax is charged where applicable.
  • Introductory, promotional or free-access periods are offered at Curemploy's discretion, apply only for the stated duration, and do not create any right to continued free access afterwards.
  • On expiry of a Plan, active Listings may be unpublished or restricted until the Plan is renewed.
  • Curemploy may revise Plan pricing and features prospectively. Changes will not affect the price of an already-purchased Plan for its remaining term.
  • Payments are processed through third-party payment providers. Curemploy does not store complete card details.
  • All paid services are subject to the Refund & Cancellation Policy.

8. No Guarantee

Curemploy does not guarantee:

  • That an Employer will hire any candidate
  • That a candidate will accept any job offer
  • That any particular number of applications, profile views or responses will be received
  • Any employment, salary, placement or hiring outcome
  • The accuracy, completeness, genuineness or legality of information independently supplied by Users
  • That any Employer, establishment or Listing is genuine or suitable, unless specifically marked as verified
  • Uninterrupted, timely, secure or error-free availability of the Platform

Users must carry out their own verification before entering into any employment arrangement.

9. Prohibited Activities

Users must not:

  • Commit or attempt fraud of any kind

10. User Content and Licence

You retain ownership of Content you lawfully upload. By uploading, you grant Curemploy a non-exclusive, royalty-free, worldwide licence to host, store, display, reproduce, adapt for formatting purposes, and transmit that Content to the extent necessary to provide the services.

You represent that you own or have the necessary rights to the Content you upload, and that it does not infringe any third-party right.

This licence ends when you delete the Content or close your account, except where the Content has already been shared with an Employer through an application, or where retention is legally required.

11. Notice and Takedown

If you believe any Content on the Platform is unlawful, infringes your rights, or breaches these Terms, write to Curemploy@gmail.com with:

  • Your name and contact details
  • Identification of the specific Listing, profile or Content, with a URL or job ID
  • The nature of the complaint and the basis of your claim
  • A statement that the information in your complaint is accurate

We will acknowledge within 24 hours and act within the timelines prescribed under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

12. Intellectual Property

Curemploy's branding, logo, name, software, design, user interface, database and original content are owned by Curemploy Private Limited or its licensors and are protected by applicable intellectual-property laws.

You may not copy, reproduce, distribute, publish, or create derivative works from them without our prior written permission. No right or licence is granted except the limited, revocable, non-transferable right to use the Platform in accordance with these Terms.

13. Third-Party Services

The Platform relies on third-party services including hosting, payment gateways, SMS and email providers, and analytics tools. Their performance is outside Curemploy's direct control, and their own terms apply to their respective services. Curemploy is not liable for any failure, delay or loss caused by a third-party service provider.

14. Account Suspension and Termination

Curemploy may suspend or terminate an account for:

  • Breach of these Terms
  • Fraudulent, suspicious or abusive activity
  • Security concerns
  • Non-payment

Where practicable and lawful, we will give notice and an opportunity to respond. Where the breach is serious — including fraud, charging candidates, or posting fake Listings — suspension may be immediate.

You may close your account at any time from account settings or by contacting us. Closure does not entitle you to a refund of amounts already paid, except as set out in the Refund & Cancellation Policy.

Sections 8, 10, 12, 15, 16, 18 and 20 survive termination.

15. Disclaimer and Limitation of Liability

The Platform is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, to the extent permitted by law.

To the extent permitted by applicable law, Curemploy will not be responsible for indirect, incidental, special, punitive or consequential losses, including loss of employment, loss of business, loss of profits, loss of opportunity or loss of data, arising from use of the Platform or from any dealing between a Job Seeker and an Employer.

Where liability cannot lawfully be excluded, Curemploy's total aggregate liability to any User in respect of all claims arising in any twelve-month period shall not exceed the total amount paid by that User to Curemploy in that period, or ₹1,000, whichever is higher.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud.

16. Indemnity

You agree to indemnify and hold harmless Curemploy, its directors, officers, employees and agents from any claims, damages, liabilities, losses and reasonable costs (including legal fees) arising from:

18. Changes to These Terms

Curemploy may update these Terms from time to time. The revised Terms will be published on this page with an updated "Last Updated" date and version number.

Where changes are material, we will provide notice through the Platform or by email before they take effect. Continued use of the Platform after publication constitutes acceptance of the revised Terms. If you do not accept the revised Terms, you must stop using the Platform and may close your account.

The version of these Terms applicable to a purchased Plan is the version in force at the time of that purchase.
